These proposed laws seek to reduce the sentences for those facing life imprisonment, especially for capital offenses, limiting the maximum term to 30 years.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under Kenya&#8217;s existing legislation, which dates back to the 1930s, individuals convicted of murder, robbery with violence, or treason may face the death penalty. The bills also aim to reclassify murder and robbery offenses to ensure more proportionate punishments for different crimes and to amend the provisions related to mandatory death penalties in line with High Court rulings and prevailing human rights standards.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">One significant change in the proposed legislation is the removal of the death penalty for individuals under the age of eighteen when they committed the offense, replacing it with detention at the President&#8217;s pleasure. Additionally, the bills aim to update the Penal Code language to align with human rights standards, especially in cases involving individuals with intellectual and psychosocial disabilities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The proposed changes include replacing the term &#8220;manslaughter&#8221; with &#8220;second-degree murder&#8221; in Section 112A of the Penal Code subsection (4) and replacing &#8220;for life&#8221; with &#8220;for a period not exceeding thirty years&#8221; in Sections 220 and 222.
