The Independent Electoral and Boundaries Commission (IEBC) will now have the authority to designate vehicles as polling stations, following the introduction of the Elections (Amendment) Bill, 2024. The bill, which seeks to amend various aspects of the electoral process, was presented to the Senate by Majority Leader Aaron Cheruiyot and Minority Leader Stewarts Madzayo.

Under the new legislation, the IEBC will have the power to appoint places or designate vehicles, vessels, or other locations as polling stations for each electoral area. “The Commission shall appoint a place or places or designate a vehicle or vehicles or a vessel or vessels as a polling station or polling stations for each electoral area,” the bill states.

A vessel, as defined in the bill, includes any ship, boat, or other navigational vessel. Once designated, these vehicles, boats, and ships will be equipped to facilitate voting during elections. The IEBC will then publish the locations of these mobile polling stations in the Kenyan Gazette and publicize them through national electronic and print media, as well as other accessible mediums, at least three months before any election.

“No election shall be conducted in a place other than a place gazetted as a polling station under subsection,” the bill asserts. However, it remains unclear whether these mobile polling stations will be allowed to move from one location to another within the three months leading up to the election.
