Chief Justice Martha Koome on Thursday appointed a three-judge bench to oversee a case challenging President William Ruto’s expanded Cabinet. The panel includes Justices Eric Ogola, Jairus Ngaah, and Stephen Githinji, who will deliberate on a petition filed by lawyer Saitabao Ole Kanchory and Julius Ogogoh.
In the case, Ole Kanchory lodged a petition at the Malindi Court, contesting the nomination of 14 Cabinet Secretaries who have already taken office. The court filing, dated Friday, July 26, 2024, reveals that the petition was filed under a certificate of urgency, with the lawyer questioning the integrity of the appointees.
According to Ole Kanchory, the nominated Cabinet Secretaries, including Wycliffe Oparanya, Ali Hassan Joho, and Davis Chirchir, are unfit to hold office due to alleged violations of the constitution regarding integrity standards. He further contends that the Kenyan Constitution requires public officers to be of unquestionable character and asserts that the ministers must not hold positions within political parties or serve as elected or nominated MPs.
