The High Court on Tuesday upheld the constitutionality of the Affordable Housing Act, 2024, ruling that it was lawfully enacted, allowing the government to proceed with its housing program.
A three-judge bench, consisting of Justices Olga Sewe, John Chigiti, and Josephine Mong’are, concluded that sufficient public participation took place and that due process was followed in establishing the housing fund. The ruling came after six petitions were filed challenging the legality of the levy. The judges emphasized that their decision addressed the key issues raised by the petitioners concerning the Act
