A university student, David Oaga Mokaya, will face a full trial over charges of publishing false information after allegedly sharing an altered image of a funeral procession with a misleading caption on social media.
The court confirmed on Wednesday that the Director of Public Prosecutions (DPP) had not issued instructions to withdraw the case, setting the stage for a hearing on May 29, 2025.
Mokaya, through lawyer Danstan Omari, had sought clarification on whether President William Ruto would be called to testify. The Law Society of Kenya (LSK) also questioned the jurisdiction of the case.
According to the prosecution, Mokaya allegedly posted the edited image on his X account, “Landlord @bozgabi,” on November 13, 2024. The image depicted a casket draped in the Kenyan flag, escorted by military officers in ceremonial uniforms, falsely implying that it was President Ruto’s body leaving a funeral home.
